negligence


definition of negligence:

the failure to act with reasonable care; a cause of action in civil courts. A legal claim of negligence is established using a two part test: (1) the negligent party must have had a duty to act responsibly; (2) the negligent party's failure to act responsibly was both the legal cause and the proximate cause of harm to another.
